Hi there,

pls advise.
thanks

While a GC holder, you can marry a visitor, but she cannot legally remain in the US and certainly cannot work. You would file for her GC as the spouse of a LPR. She would need to leave the US and return only once she receives her GC. Check the visa Bulletin each month for the current priority date. It is now about 2 years but that varies widely.

Be advised that an illegal overstay will not be able to adjust status as the spouse of a LPR. She can only work once she has authorization.

If she qualifies for an H1B or L1 visa, she may have her employer sponsor her in the interim. If no, she needs to expect to go home and wait. Illegally present foreign nationals are subject to detention and deportation.

thanks your time.
We dicided to marry with in month and she can go back i try to apply for I-130.wait Untill approve.
untill she can visit or i can visit every 6 months or somthing.
but i want to know what will be time frame. if its takeing 2 year. or i can file after my citizenship.

The backlog for spouses of permanent residents is currently 3 years.

File the I-130 now, and then upgrade it when you get citizenship if she's still waiting at that time.

You can file it while she's still inside the US. Just make sure to select a convenient consulate for question 22, and she can remain in the US for the rest of her 6 months stay (how however long they granted her on the I-94) before going back.
