GREEN CARD STATUS...? MY WIFE( usa citizen) and i(immigrant) are divorcing, i will lose green card?
i will lose my cond. green card and will have to apply for a work visa... im worried because her and i have two children together and i am praying i will not get deported because of the fact we are divorcing, if i get denied a work visa ( i work for oklahoma departtment of human services, comp engineering) i will not get to be in the kids life. nor support my kids finacially like i can in america. has any one been through this or know how work visa's work paticulary a e-b3? or could i apply by my self after the divorce for a green card on basis of our marriage and children together? my divorce will be over maybe around may and my cond green card expires in june i need help!

Why don't u try and work out things with her and see if she'll reason with you so that u can get the conditional part off.
 
Hyder...u are already a conditional resident and if you are getting divorced before ur I-751 to remove conditions you do not need to change to work Visa till ur conditional status expires. And u can file I-751 without ur spouse but have a good attorney file it with sufficient details on hardship and etc... so that you can get your permanent GC. many people go through this and i do not see any issues if u have kids and as long as you can prove that divorce was not avoidable and the initial marriage was in good faith.

Chill and look for a good attorney who specializes in family immigration.
 
Calm down, you are not the only one in that situation...many are in the same. Get a good lawyer and there is a possibility to apply with a waiver once you are divorced. One of your main evidence will be your children birth certificates or that you are part of their custodian. There is no need to rush to change to a non immigrant visa since you are a permanent resident so far. Please, make a consultation with a lawyer and s/he will clarify properly your doubts. Take all the information that you can, statements of accounts in common, assets, birth certificates of your children, etc.
