This site was very helpful with our immigration experience (hasn't even started really ). I am former au-pair, was subject to 2Y HRR (actually I was assigned residency requirement by mistake and I got letter clearing that mess out).
I met my husband shortly after I came to the USA and we decided to get married when we realized we wanted to spend our lives together.
We got married in December 2005 and haven't filed yet due to different probs we had and now we are almost ready to send everything in.
My legal status (J-1 visa) expired in February so I'm in a third month of overstay.
I have a non-restricted SS# and I accepted a job in March (without a work permit because I hadn't filed for the AOS yet).
I am paying my taxes I will state in legal documents that I am working.
My questions are:
1. Can they take any legal action against me?
2. Can my employer get in the trouble?
I certainly don't want to get him in trouble. Considering my position, some ppl say that immigration might think I got married for papers because I am working without permit but I am not so much worried about that because our marriage is real and we can proove it emotionally and legally.
I'd like to hear different experiences and views, maybe legal advice.
