Hi Guys,
I'm lurking on this forum for a while now, and find it truly helpful. I went thru several thread about applying for both green card/ citizenship, and few questions arouse, on which I hope some good person can help me. All answers are greatly appreciated.

Little background:

- My wife won a green card thru lottery and came to US in May 2004

- Myself, in 2005 I enrolled in WORK & TRAVEL program and came here ( we weren't married yet)

- I extended my visa ( switching to B2)

- Before its expiration we got married 03/2006

- At that time my wife filled i-130 form for me

- My visa expired, and my status is "pending"

- she can apply to be a citizen in May this year, correct? (5 years)

My questions are:

- I know she has to fill in n-400 to get citizenship, what should be ma action plan? Should I follow the standard procedure ( i-485, i-693..etc) ?
- How to upgrade my i-130, since she'll no longer be a resident? ( should we do it or just apply for me?

- Since I had a social security number from my Work & travel - I was working full-time while studying ( and honestly paying taxes each year) - can it affect my application?

- How approximate time frame we are looking at before I'll get my green card?

- Should I see a lawyer because my situation is more complex than normally?

Again, thank you so much for any helpful thought that may arise..

Best,

Arv

Your status is NOT pending. You are OUT OF STATUS.

Her I-130 does not grant you any status or right to stay in the USA. Neither are you authorized to work.

You must wait until her citizenship is approved before you can file I-485 and I-693. You need to seek an attorney for consultation about the specifics of your case... you should not be working illegally and you still got at least 18 months to go before you can apply for a GC.
