married to USC/applying for F1

Good morning everyone!

I am a Canadian married to a USC. I am living in Canada and he is living in the US and we are in the process of preparing for our Immigrant Visa application.

I am also considering studying in the US (I have studied there before, have a degree from there and understand the I-20 process) but my worry is that it will complicate the IV process. Would it be advisable to apply for F1 and if it is approved apply for adjustment of status (I-485) once in the US? Would this complicate my chances of getting a GC in the long run? Would the fact that I intend on adjusting status make it impossible to get the F1?

Any advice would be appreciated. Please point me to any forums that could help as well. Thanks!

The problem I see with this is that F1 is a non-immigrant visa, requiring that you have non-immigrant intent. The fact that you are married to a USC points to immigrant intent already. You are probably better off waiting for your immigration paper to go through. But that's just my opinion. Hop over to the Family Based - Marriage Visa forum under the immigrant visa category. Maybe you will get better answer there. Best of luck to you and congrats on your marriage!

The above is just my opinion only. Please do not use it as legal advice. Consult an immigration attorney when in doubt.
