Married, Now wife off to grad school in different state

Hi,

I got married 05/2004. We have been living together since 12/2003.
We dated for more than one year before getting married. Both of us are originally from India.

Wife expects the citizenship by 10/2004. She would file for my green card based on marriage.

She intends to go back to a grad school in Texas. I am in DC.
I am on H1B and have a fabulous job. Secondly it's hard to find the job I want in the city her university is located. It means that just two months after the filing of GC papers I would be living alone.

1) I heard that INS people do visit the houses? In my case I will not be staying with my wife. How will it affect my case?

2) Should I mention in the applicationo paper that she intends to move away because of higher study?

2) Will it be better if she files for my GC from her city. But then we would have lived here for almost one year by then and it will be easier to show the INS officials here that we indeed lived together.

Any thoughts.

I doubt INS has any such person who do visit house.. If they have that kind of people then they may put those people behind locating overstaying non immigrant people then actually legally applying person.

Eventhough she may be staying away from home or you may be staying away from actual home you should still have her on your apartment lease, Bill, credit cards, car insurance etc. And for sure if you are working on H1-B visa and she is studying you must be paying taxes to the government as "Married file jointly" 1040 federal form showing you and your wife filing tax jointly is good. Is there in application there is any question where you have to tell them that you are not planning to live together? Why create problem by disclosing something they dont ask?

Do some research on where to file "office" in from your area. Generally you can say where you all get your mails and you do stay is the place you live.. IMO.
 
Hello:

Firstly, I honestly doubt that the INS visits peoples houses as that would be a very time consuming and expensive affair and is not very practical. They do ofcourse check for proof that you guys have lived together and have joint bank account and utility bills and other bills coming to the same address.

Secondly, I dont really think you should bother mentioning that you guys are living in different towns as that is not really something they need to know till the time of the interview(my personal opinion ofcourse). Telling them in a way may give the INS officers a feeling of suspicion and doubt about the marriage.

Thirdly, I may be wrong but even if she is away at school and is still getting bills and maintains her residence in the house at your city you can easily submit paperwork from your city. And ofcourse she probably will be coming to your city during summer break and winter break and other holidays.

I dont think you should have any problems with your process. Best of luck.
