Married Non-US resident needs work permit

Sorry for the title. I wanted to make the basics clear. I am a US citizen. I've been friends with my current wife for about 2 years. We met online playing counter-strike, please don't judge. So I went to Belgium in Oct of 2007 and we started dating. She came to the states and stayed with me for a month in Feb 2008. She came again in July 2008 and stayed til just a few weeks ago. No Visas or anything just stayed. The day she left we got married here in the States. So I'd like her to be able to work here for about six months while I study Dutch and finish one of my certifications, then we're likely to move back to Belgium. I'm sorry again I'm probably not in the right area I'm just confused. I really don't need any kind of permanent residence for her just a permit for her to work here for at most a year. What should I do?

how long will this process typically take to get approved? For the Visa? For the H1B? How long til she can work?

For a H1B visa, first you need a company that is willing to sponsor you for the visa and shell out $$$$ for you. Theres also certain requirements that the applicant has to meet (such a hold a degree or have 12 years of experience in that field). Once they complete the paperwork they submit it on April 1st 2009 (this is the application date of the fiscal year) and then its basically a lottery. Theres 60,000 available visas and usually 3 times as many applications, therefore more people end up with no visa then those that dont. If successful, a H1B visa will be issued for a start date of October 2009.

If you can find a place a institution that is cap exempt (not restricted to the 60,000 quota) then you can get the visa earlier...cap exempt places are usually places such as universities.

Going by the rate that CR1/IR1 visas for spouses are being approved (10-12 months), this will probably be a quicker route for you.
