Married in India, Do I need to get officially married in US for Family based GC?

Hi,

We were married in India in Dec 2005, my wife is a GC holder and applying for her US citizenship in Feb 2006.

1.Should I wait till my wife gets her citizenship and then apply for my GC?
2.Do we need to get legally married in US, before I apply for my GC? If we file our 2005 taxes with married status, is that acceptable?

If you have a marriage certificate from India then you don't need to re-married here because US does recognize marriage done in India.
I would say you should just wait till she become a citizen for filing for your GC. Its less complicated and will not make any differance.
Yes you can file joint taxes for 2005. Infact it is advisable to file a joint returns.
