Hi,

I'm a permanent resident since 10/02/10 through my US American mom (F11). I also got married on 10/10/10 and I am wondering if I could file soon for citizenship because we will have been married for 3 years.

When should I file and how do I do this?

Thanks a lot!

You will complete 3 years of marriage on 10/10/13, so you can't apply before that. You have to complete at least 3 full years of marriage to a US citizen at the time you apply, and your spouse must have been a US citizen for at least 3 years.

The 90 day headstart is only for your years as a permanent resident, but not for the 3 years of marriage. You need 3 full years of marriage when you apply, so only the people who got married before obtaining the green card can make use of the 90-day early filing period when applying with the 3 year rule.
