Well here's the story. My wife and I have been married for 2 years and have an 18 month old daughter. My daughter and I are both US citizens, however, my wife has an order for deportation since 2002. We were told by a lawyer that since the marriage occurred after the final order for deportation we were SOL. I want to petition her but am afraid of her getting picked up during the interview process or anywhere else for that matter.
Is there anything we can do at this point? Also, how long would the petition take given there is a waiver that must be filed for the 10 year ban from the US? Any advice would be appreciated.
