Marriage with Green Card holder

Hello Folks,

My cousin is in a dilemma. He married about 2 years back in India and he was a green card holder at that time. His wife came to the US on a student visa, which she got a couple of days before marriage. Now he is about to get his US citizenship, but the question he has is, should he re-marry with his wife in US again or apply for the Marriage license here, since he didn't get a marriage certificate/license or any official note when he got married in India nor did he register the marriage in any courts in India. or would the INS accept the marriage in India as official?

Also, he has been filing his taxes as married since the last 2 years.

Any thoughts, suggestions would be greatly appreciated.

Thanks,

Rice

He should have registered his marriage in Inida when he got married. India's marriage certificate is valid here.
Try to get the marriage certificate from India if he can. If he gets married here, then she will get conditional GC since the marriage will be under two years.
