Hi all,
I am planning to marry my fiancee who is a US citizen while i am an international student.I am concerned about the i-130 petition because she is gonna be going out of state for college.I am thinking about the rule that we have to live together as husband and wife but i dont want to jeopadize her education because she was accepted in to a good university out in virginia while I live in new york.Is there anyway we could go around this?We both college students and been together for the past two years.Thanks

Living together is a test of the authenticity of a marriage. So in your case if you dont live together and the reason is school then it appears valid. But you know they look at a whole range of things, you guys have to appear to be a normal family. For example in her school fees, lets say she is on loans, having you as a co-signor might strengthen your case to immigration officials.

My simple point is that if there is enough proof of intermingling in your relationship, mostly financial and beyond, then you should be fine. If your relationship is genuine, there is nothing CIS can do to deny you the benefits, although it might take time to adjudicate.
