I have seen a similar posting with spouse filing for 485 while on F1. However would like to describe my situation as it may have some other corners.
I am presently on pending 485 (texas center, date Dec 2001). I have done my FP already so 485 may be approved any day.
I am trying to make a decision to marry a F-1 visa holder. However a bit confused as to what to tell her and her family about the immigration situation so that they can make an informed decision. Following is what I see are the options
1. I get married soon to her (both of us in the USA). Go ahead and apply for her 485/EAD/AP. She will not be able to travel till AP is approved. Is this all thats involved? Is there any conflict here in terms of non-immigrant intent of F1 and application of 485?
2. I get married soon but my 485 is approved in the meantime (a slim chance hopefully). Now she is married to a GC holder. She can continue her studies till the visa is valid but cann't renew it or change school. Would she be able to travel abroad? Once done with studies she can apply for H-1 if she gets a job and then proceed with her GC on her own.
Let me know if I need to conisder other aspects and also if any of above assumptions are wrong.
