Hello

My wife has become a citizen, i am on H1-B..Need to File my papars...she is a student .
does my salary count towards to HouseHold Income & what form do i need(864 or 864A)??

How soon should i get my EAD in vermont...

does entire package goes to Vermont?????

Please Help
 
Hi,

your income cannot be used for the I864. If your wife is not able to file the affidavit she can use a co-sponcerer (a USC or a PR holder) to file the I-864A

You should send your Adjustment of status to your local district office and not to the service center.

EAD issuance time frame varies from a day to 90 days which actually depends on the district office.

Yes, you can use your income on the affadavit of support. The only catch is that you both should have lived together for atleast 6 months. Read the instructions on the form. They are somewhat convoluted but it says it in there.

I asked this to an immigration lawyer and he confirmed this.

And Local INS office that means i am in NEWARK area the entire package goes to NEWARK? Not VERMONT???

All Adjustment of Status cases based on "Marriage to a US Citizen" go to your district office which in this case is NEWARK!!

Hi! I'm new here .

I dont know if this question had already been answered but i gotta ask anyway:)
My Father is a US citizen african-american ex- Navy , I'm from the Philippines , I've been here since 1997 but my brother and Mother are still in the Philippines, my Dad want's to petition my mother now, they've been married for almost 3 yrs. now . Me and my dad don't know what forms we need to petition my Mom , I hope some of you will be kind enough to help us w/ this .

Your dad needs to file I-130 at a local INS district office. Once the I-130 has been approved, your mom will be asked to appear in an interview at the US embassy in the Philippines. The whole process shouldn't take more than 7-8 months.

thank you for the Info but I also wanna know if b/c my dad is petitioning my Mom would he also need to submit a G- 325A along w/ the I-30 form? Thank you again.:)
