Marriage and US education: what comes first?

I am a US citizen who married a Brazilian citizen 7 years ago, but being young and naive never completed the process to completely help him get permanent residency (and never got a divorce).

Now I am in a commited relationship with a German citizen and we both would like to attend college together in the US. What would be the best approach? Should he apply for a student visa then we get married on a natural time scale? Or should I get a divorce while he applies for a fiance' visa and after we get married he applies for college? Should we marry in the US or Germany?

Will immigration suspect foul play if I again want to marry an non-US-citizen? And how long does divorce take and what if I don't know where the Brazilian man lives?
 
If he intends to marry you and become a permanent resident/green card holder, it is a violation of immigration law to try to enter on a student visa, because that visa does not allow for immigrant intent. What you should do is get a divorce, then work on getting your fiance a green card. The best to do is probably to get married and for him to apply for an immigrant visa in Germany, because processing at consular posts are much faster, especially in a Western EU country like Germany. It'll probably take 2-3 months, and then when he enters the U.S. he will get a stamp in his passport that proves permanent residence and his date of permanent residency will be considered to start on that day.

If you want to do it inside the U.S., he has first to apply for a fiance visa at the embassy/consulate in Germany, get it approved, then come to the USA, marry you within 90 days, apply for adjustment of status to a permanent resident, and then wait a very long time.

Bottom line: he should not apply for a student visa. You should get a good immigration lawyer. The best idea is probably to apply for an immigrant visa in Germany after you get married.
