My friend came in on a H1-B and was laid off within a month of coming here, but he stayed on to search for another job. He has a girlfriend who is a US Citizen. She wishes to marry him and apply for his Green Card. Would the INS consider such an application or would the INS consider him out of status in this country before marriage and therefore not accept his application.
Please help.
 
Even though he might be out of status, by marrying a USC he has a right to remain in US and wait for processing. This is the easiest way to get out of the situation.
 
when your friend does apply for his green card / advanced parole make sure he dosent apply for the AP (he is already out of status) and will probably barred for 10 years from entering the us based on his overstay.

his best bet is to wait for his AOS to be approved and then travel!
