hi, im an f1 student here in the US then me n my GF are planning to get married soon and sponsor me for a green card but the problem is she's still 17. what is the legal age for the marriage petitioner?

thanks in advance

In most States, it is 18 without parental consent. With parental consent, it varies. There is also judicial bypass.

Not sure what your question is. Are you asking the legal age for marriage? or you like to know how old the sponsor should be in order to apply for GC for a spouse? And...Is your GF a USC?

the legal age for the sponsor coz i know that u can get married if you are under 18 with a parents consent but my problem is the age for the sponsor

yes, she is a USC

She has to be 18yo. However, if she still depended on her parents, it will be a big red flag for the immigration officer that your marriage may only be for your adjustment of status and not to really marry her and live tgether... (real love marriage)...

My 2 cents...
USCIS would reject application if age of sponsor spouse is less than the marriagable age as defined by law. The only situation where age is defined is when USC is filing for parents; in this case the USC has to be atleast 21 years of age. Eitherways, sponsor would have problems meeting minimum income requirements due to age. You being on F-1 "might" add to that problem. So be prepared to show assets or arrange for a joint sponsor.

Can i ask how old you are?

just turned 23

coz i heard that u should be at least 18years old to sponsor a spouse for GC
i didnt know that u should be at least 21 yrs old

Its only 21 when you are filing a petition for a parent, I think thats what Ari said. I'd wait until she's 18 if i were you, does your gf earn enough to show sufficient support right now? or does she have assets/a joint sponser, as I believe this would be another stumbling block.

Let me repeat what i wrote earlier. The marriage age as defined by law in most states is 18 years. So if you got married before you or your GF turns 18, your marriage is not legal, and in this case, USCIS will not recognize you as husband and wife either. Hence your family application for GC as the spouse of a USC would be rejected. As others pointed out, 21 years is the age the USC sponsor has to be in order to file GC for parents.
