March 2003 - Manifest Case Approved!!

My FBI check was stuck in limbo for a while. FBI claimed that they had never received a name check request from USCIS and USCIS claimed that they had infact sent a name check request to FBI. Finally USCIS informed me that my case along with similar other would be put on a manifest and sent to FBI. At that point I said screw it. But thanks to Senator Carl Levin's office the mess was sorted out. My case is now approved. Online status never changed but the LUD did change.

For other who have been stuck as long as I have - Have hope and contact your senator if the delay is inordinate.

Congrats!!! Could you please share your experiences? Like what you have done?

I'm EB2 and filed my 485 Oct.2003. I've contacted USCIS twice on case status... And I've just done an FOIA check. no record... what should I do next? My lawyer said there's nothing he can do...

Please advise. Thanx!

Fortunately my lawyer was a little bit more receptive than yours. He suggested that we contact a senators office. He called up the senators office and started an inquiry through their office. Twice they came back with wait for 60days then we will see. After the second 60 days were over my lawyer contacted the senators office again. This time he got a very quick reply from the senators office that my case will be with the adjucator within a couple of bussiness days. I was prepared for another 60 day wait but to my surprise I got my approval soon afterwards.
I feel I owe it to my lawyer. He did not have to do anything, I had paid him in full way back when.

Congratulations!

When was your name check cleared? Do you mean that your online status did not change while LUD changed at the time of approval? Did your LUD change at the time of name check clearance?

My LUD changed 3 days before I received the approval notices by mail. It did not change before that. The online message never changed.

I don't know when FBI name check got cleared (But LUD did not change at all until 3 days before I received the approval notice by mail). But I had submitted a FOIA request to FBI sometime back and it came back with no records found.

Good luck timaeuti!
