My husband just got his passport stamped and is waiting for a green card, apparently is all approved for his green card. We are not legally married yet because he also had a second case open with USCIS which he needed to be single, a green card thru his mother. We have been living as married for 5 years and just his case was holding us from getting married. I came to USA on a turist visa and stayed and it's been 10 years already.
Questions:
1.Even though he is already legal here but does not have the green card on hand yet, can we get married ?
2.If we get married can he apply for a green card for me as soon as we get married or should we wait a while to not look like we just got married because of a GC ?
3. After we applies for me, how long on average it will take for me to get a work permit to allow me to work legally ?
Any help is appreciatted.
Thanks.

Here some additional information. My husband GC came through an old case that was archieved. About almost 20 years ago he had a bad luck with a lawyer . His lawyer died in the date he was supposed to appear on INS, so without speaking a single word in english he got denied. A couple years ago the case was reopened. I'm not sure but I think his case was the last amnesty in the USA. Anyhow, the case was reopened and he got a GC through I485. Today he got in his passport processed for I-551.

Hm.. So what is his first case, GC through employment?

First of all, don't leave the country, because of your overstaying, you will not be able to get back in the US for 10 years. Your husband is not a US citizen, so it won't be forgiven.

If you want to stay with your husband, you will have to hold on for a couple more years. I think the best option would be to wait until your husband can apply for citizenship. Then your overstay will be forgiven and he can apply for your GC.

Please do wait for more opinions on this.
Good luck to you!
