Mail-in I-129/I-539 time frame

Hello. Forms I-129/I-539 on way to Vermont 3 months prior to expiry.

Government says file 45 days (month & half)prior to expiry to allow ample time to get approved or rejected. Recently someone on the forum has been waiting 4 months without any word. What's up with this??

What does one do if TN expires while they waffle around? What options does one have if they file plenty early but goverment cannot process in a timely manner. Is this the TN applicants fault?

I would like to see some discussion on this. Thank you.
 
if you file a TN renewal (or any petition for that matter) with USCIS before the expiry of your current TN and then the service center does not process your renewal in time before the existing TN expires, you are allowed to remain working at the current job for 240 days while the petition is pending. Of course if you leave the country the petition will be considered abandoned, so you would have to apply for a new TN on re-entry.
