I think the USCIS online case status thingy is back online. I got a LUD on my I129 on 10/21/2007.

That's correct. Even I got my old I-129 LUD as 10/21/07. I am wondering, what is cooking.

I got LUD on 10/21/07 fo I-140

I-140 approved on July 2, 2002.

Nothing on I-485.

Stuck in NC since 3/9/2003

I got LUD on my AP today with following message

we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our TEXAS SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

Count me in. Got LUD yesterday on one I-129 (approved in 2003).
No change in 485, still same 03/27/07

Perhaps they are comparing the previous approved applications with the pending 485 application for consistency? If there was a major deviation, can it be accounted for by a valid reason?

Things that come to mind are:
skillset, wage determinations, paystub/W2, work location, employers etc.

Also, they might be interested in any special annotations made in the previous applications while they were being processed.

I believe it is a good thing in general if any of your applications (pending/approved) have been touched. Better for someone to be looking at your application rather than it sitting in a corner gathering dust.

I got 2 LUDs yesterday and today after the RFE response on AP. I hope to get the AP - inshallah pretty soon hopefully by tomorrow. Will update you ... once i have that approval e-mail.

Thanks

Makes sense.
Also could it be a sign that name check is making some progress, if it is stuck for long time?

I think files of people who have been stuck in the dreaded name check for a long time are finally being looked at.

Two cases in particular that I know of are my own and Akbari. We both got a LUD each on our old cases. I received FP notices and he probably got an RFE (he might be able to give an exact update). Same might be true for other old cases stuck in NC.

A true test would be what happens once USCIS receives the responses/results of these latest actions. If there is progress then it would definitely mean the name checks have been expedited and are bearing results.

If that is the case then I will be able to give a more thorough analysis and prolly a more calculated guess as to what is happening.

This is what I think

I think the following is a likely scenario:

DISCLAIMER: The following steps are based on educated guesses and recent trends. Any similarities to any person or actual events is entirely coincidental.

a) An automated batch job kicks up some dirt on the weekend and looks at the oldest pending cases (mostly stuck in name check) and picks out a fixed number of cases. Move on to step (b).

b) The process presents the old selected cases to the IO on Monday.

c) IO looks at the cases one by one checking to see what the cause of the original delay was and if anything has changed since the last time the batch process ran. If answer is Yes, go to next step (d). If answer is No, go to step (f).

d) If the IO sees that the cause of delay (eg. Name Check) is clear now, he/she looks at the rest of the case and checks if there is anything missing.

e) If there is anything missing (eg. FP, Medical tests, paystubs etc), the IO generates an RFE or FP notices.

f) Since there is no change and the delay (NC etc) has not been answered, send file back to the pending stack, to wait for the next instance of batch process.

Online status says: On Nov. 6th a RFE was sent but do not receive it yet now. How long did a RFE take to arrive? Thanks

In My case, RFE was sent on Nov. 08th. The lawyer received it yesterday (11/14). But don't take it for granted, I saw people in this forum got the RFC after 2 weeks. You might want to check with your lawyer. Maybe s/he has received it.

11/25/2007 LUD on I-129 approved in 2004

I also received an LUD on I-129 which was approved in 2004. I am also stuck in NC. I also had an LUD on 09/30/2007 on I-140 which was approved in 2006. However, no LUD's on I-485.

Let's hope for the best...

Please let us know if any one's NC get's cleared after LUD on I-129 or I-140.

Thanks,
