LUD on 485 is 12/10/2004

The LUD on the 485 for my wife and I is 12/10/2004
The message remains the same which is

There is no change in LUD or message for the 140.

Could this mean anything? or is this another Mass update??

My company is getting acquired on 12/24/2004.
Hopefully I can get my I140 approved before then.

1st LC - August 2001 - EB2 - withdrawn in June 2002 due NOID (part acquisition not successor of interest ?)
2nd LC - August 2002 - from current company - EB3 - (company only applies EB3 - strange)
SESA to DOL - July 03
Remanded to state - Oct 03
Approved - March 04

140 RD - - 05/03 - LUD 05/05 - pending

485 RD(Mine) - 05/15 - LUD 5/18, 10/27, 12/10 - pending
485 RD(Spouse) - 05/15 - LUD 5,18, 10/27, 12/10 - pending
485 RD(minor) - 05/15 - LUD 5/18, 12/10 - pending

FP done both - 06/22 - before appointed date(07/21)
EAD recd - 06/24
AP recd - 06/29

Can I hope to get approved this year?

RFE on SEP 21 st 2004(Company financial audited statements and w2 forms of mine 2001/2002/2003)

My attroney responsded and they received the response on Nov 23 rd 2004

My attorney send me a copy of filling to me: in the response he said

X company was acquired by Y in jan 2003(which is a public company) however still operates as wholly owned subsidiary, for your referemce we have enclosed a complete copy of acqusition as wells as X company's 2001 and 2002 audities financial staments, to establish the petitioners current ablity to pay the beneficary wage we have enclosed Y 2003 audited financial stament. Y statment was audited as PARENT COMPANY AND NOT AS AN OPERATING SUBSIDIARY COMPANY(I.E x) also we have highlighted several of the acquistion refrences found in the financial statment.
