LPR to bring Child born in India with Egg donor

Hi,

I am an LPR in US and married to US Citizen. We have had mutiple failed IVF and now want to use anonymonuos egg donor from India . I wanted to know when child is bron, would i be (as an LRP) be able to bring child back to
US and after coming here file for child's I-140.

I would really appreciate any infomration in this regard.

This is bound to be complicated. It's probably even more complicated if a USC is not the biological father. You need a lawyer, not an anonymous message board.
 
Egg donor is different from surrogate mother. If it's just a case of egg donor procedure, then you the LPR would be the one pregnant (hopefully) with your USC husband's child and as such there should be no question as to who the parents are and if you can travel back to the US with YOUR child. If you however use a surrogate to bear the child then you will definitely need a lawyer because you may need to legally adopt the child.

Will you use surrogate mother or just the egg ?
Two are different.

I understand this is complicated and will take help of Lawyer for sure. But apart from that, I wanted to find out if someone has gone through this process so that we can understand issues/hassles better by exchanging mails..

That makes it doubly complicated. Unless you become a US citizen before the birth, the baby will not gain US citizenship from you being the father; your USC wife probably would have to go through the international adoption process and green card process to bring the baby to the US. That would significantly increase the time and cost. It may be a good idea to wait until you become a US citizen before going ahead with this.

There are probably forums elsewhere on the web that are focused on international surrogates and adoption; those would be more suitable for you than this one here.

I am in exact situation of yours. I spoke to an attorney last week about this, i paid $ 250.00 consultation fee. But he said it is much easier to bring as a step child. He said he will look into it in more detail and get back to me. I am waiting for the last 4 days. It will take some where between 4 - 9 months to bring a step child

US citizen wife and LPR Biological father - Egg donor and surrogate

I am a LPR and eligible to apply for citizenship in Sept 2013.

My wife is a Citizen. We are expecting our first child thru a Surrogate and egg donor outside US in Sep 2013. My wife is not the biological mother, but she is the citizen. We consulted an attorney and he said the easiest way would be to bring the child as the step child in the priority category. Can any one refer a good attorney or steps involved in bringing the child.

Do i have to wait to till i bring the child to apply for my citizenship. I will have to wait outside the country till this process is complete and don't want to make multiple visit to USA for finger printing, interview and oath ceremony.

I would appreciate any response.

Are you the biological father? If not, the child won't qualify as your wife's stepchild, at least not until you jump some additional legal hurdles.

It doesn't make sense to apply for citizenship if you're not ready to be in the US for fingerprinting, interview and oath.
