Guys,

I-140 EB 2
ND Nov 2002
RFE issued on March 3rd 2003

Lawyer and employer are saying that they have not received the RFE notice... What can an individual employee do at this point. There is no way to find out whether they have received the notice or just want to delay the whole process.

Any pointers/suggestions...

If the RFE is not received your company lawyer can inform the CIS by calling them. They would send another notice. Correspondence from the CIS is usually lost if there is a change in address. Has your company address changed after applying?

You said the RFE was issued on March 3rd 2003. Is it 2003 or 2004?

If it is 2003, your application certainly would have been denied by now. They usually give you 90 days to reply.

I guess it is 2004, in which case it is abouttime.

Correction,

The RFE was issued in March 2004 and not in March 2003 (typo)...

The company nor the lawyer changed the address...

Both Lawyer and Company are not ready to contact BCIS, but want the RFE to come by snail mail. I suspect they already have the RFE but want to delay the response (90 day) so that I am forced to work with them till my I-140 is approved. I have already crossed 180 days on my I-485...

Can employee receive a copy of I-140 RFE by communicationg with the BCIS (via phone, email, fax).

Thanks.
