I Went to infopass yesterday. I was told that my file in sitting because they are waiting for the result of my old pending I-140 at Administrative Appeal Office. I had old labor certification under EB3 from the same company filed on November 2003 which got certified on August 2006 then we file I-140 under Exceptional Abililty Alien (EB2) with all document required but got denied because my labor under EB3. In the mean time we filed PERM EB2 labor, got certified and we file I-485 and I-140 concurrently on March 2007. My I-140 for the PERM labor approved within 4 days. Now at this situation my I-485 should not be dependent of I-140 appeal still pending at AAO office. Please post your comment.

Thanks

I had a labor filed in EB3, 8/2006, stuck in backlogg, got certifiied in 11/2006.
Filed I-140 in 12/2006 and approved in May 2007.
As eb-3 was backloged and job requirments got changed so file new PERM EB2 in 1/2007, got certified and file concurrent I 140/I485 in March 2007. This I- 140 get approved in 9 days.
Since than I have been waiting and waiting and waitin.......
Infopass said all checks cleared, wonder what is holding the
case?
