Hello everyone, please help. My wife entered US with BCC visa from Mexico in 2008, and she has been (overstayed) in US ever since. We recently married and I noticed that the I-130 form ask for I-94 number, but she lost it. Do anyone know what I should do? I was thinking about applying for I-102, but she doesn't remember exact date she entered US or the date she received her I-94. Thank you very much for your help.

Fortunately she entered not too long ago so her records should be in their entry exit system. The date she received the I-94 is the date she entered the country. Come on, she must have idea of the week at least that she entered the USA, its barely even 5 years ago.

Use the I-102 and add a small note indicating you do not remember the exact date however provide an idea about the date range. Also include a copy of her visa.

Alternatively, you can file an FOIA request for her arrival departure records which will provide you with her entry date and subsequently file the I 102 but that will take a few more months.

Best.

With a border crossing card/visa, they usually don't issue an I-94. Does she know if she got one in the first place?

Does she still have the card or visa, or at least a copy of it?

Thanks everyone for answering. She still have her visa. So can i just give them a 2 weeks date range on the date arrival? How about the i94 # that they ask in the i102 form when she doesnt even know her?

Since they don't usually give I-94 for people using a border crossing card, she might not have received one and the I-102 won't make sense.

Does she remember the place where she entered? Does she know if it was a weekend or weekday or holiday? Has she tried digging through old emails and Facebook posts from the approximate date range in 2008? All those details may help her figure out the exact date.

she crossed the border from Tijuana to California. then she received her i-94 when she moved to Denver. What should i put in the form i-130 if she did not received the i-94 form?

My wife said she did get a white piece of paper that allow her to stay for 6 months. So I assumed that it's i-94. So can I file i-102 to get the i-94 numbers even though it is expired? Would they deport her if I file the i-102?

That must have been the I-94. File the I-102 along with the I-485 and a copy of the BCC.

Did you enter the US legally? Do you know the date and place where you entered? Do you still have the passport you used to enter the US, or at least a copy of it?

Yes I entered legally, but I don't have the passport is over 29 years ago...,my uncle can't find any record...that's my problem..I have nothing to show at all..and record can be found...

I meant to say no record can be found. My uncle said I came through New York airport...but can't remember the date because is so long ago
