Lost EAD card..do i need to surrender while stamping....

i came to know about this site very recently...it is very very...good.
Can somebody help me out,i have a question. I applied 485 on 09/28/01 and got EAD approved on 12/08/2001..but since i changed my address...somehow my EAD was missing,but my wife got her EAD to the new address. I spoke to INs officer and they are saying if i didn't get ...i have to reapply. attroney also says the samething.

Actually my question is if i go for passport stamping , whether i have to surrender my EAD(iam in NJ) which i don't have. Can somebody answer my question.

I have been told that the stamping officer is supposed to collect the document of your last status (for the purpose of invalidating them). But, I have seen a few posts where the applicant had to remind the officer to take the H-1B notice or EAD (whichever was applicable). In my own case, I had an EAD (never used it) and an extended H-1B but neither was asked for. My wife's H-1B wasn't demanded either. All they wanted were the passport, notice of 485 approval and the photographs!! That's it!

But, again, it all depends on the particular INS office and the officer handling your case. Personally, I see no problem in your case, as the 485 approval is supposed to supersede and automatically invalidate the EADs and H-1Bs that one might possess.
