Dear:

My petition for H-1B was approved and the approval noticed was mailed to my lawyer's address. My lawyer mailed this notice to my working place. It's been more than 4 weeks. I assumed that the notice is lost in the mail.

What should I do?

1. Can I directly call BCIS and have them re-mail the new I-94 and approval notice?
2. Will it affect my status, will the new I-94 number/approval number change?

Please advise,

answer: Your attorney will need to cal USCIS 800 number and request another approval receipt OR Fax/ Mail a letter to USCIS requesting another approval receipt and include your case number in that letter!

2. Will it affect my status, will the new I-94 number/approval number change?
Answer: This should not affect as status as long as it is approved!

Your lawyer needs to request a copy of the lost document. That can be done using form 824 - Action on approved petitions. There is an approx $120 application fee. The worst part is that it takes tooooooo f....... long. I had gone theu this pain in 2001 and my duplicate took 10 months to come. Hope its faster now.
I think its cheaper and faster to apply for another H1.
Anyways you can get the processing time and fees from immmigration.com
Apply ASAP as this takes long!!!

Don't be misguided

I was in the same situation last year, when my wife lost her approved F1 with I-94 at the bottom. My attorney suggested me to file I-824 as Ramneek is suggesting, but that is not the form you need to fill.

I called USCIS cust service and suggested me to apply I-102 and I got the replaced approval in less than 2 months.

Did your lawyer made a copy before he mailed you, if yes then that would be good and if not then also you shouldn't have problems.

You can also call USCIS and check with them.
