Looking for some advice

So this may be a rather confusing post. My good friend married this guy about a year ago in hopes of keeping him in the US. He was in jail at the time and was later transferred to prison. Right before he was going to parole he was picked up in California and taken to what I am told is a INS detention center in AZ. I'm a little confused about his status. Somehow he is tied to his mothers citizenship. He barely applied for citizenship in July and does have a rather extensive criminal record. A friend of mine said he thought their marriage was not legal. He said a person must apply for citizenship prior to getting married. So I was wondering if that was true. The other question I had was that, when a person is taken to one of these facilities, are the chances of them getting deported greater? The reason I ask that is because I would not see why they would take him rather than just letting him out and letting him go to the proceedings on his own. The friend of mine that married this guy is just concerned and wants to know what to expect.

Not sure why she would do such thing when a guy has criminal background .But that is not my problem!!.Now my 2 cents..For Green card or citizenship you need to be clear from any offences or charges to even qualify for it.If it is more than misdemenor charge.He is SOL..Only reason INS takes people to dentention center is he was not able to present proper residency documents or is proven he is out of status.There he will produce in front of immgration judge who will than decide if he is eligible for future proceeding or needs to start packing to head back to origin country.Only reason I know this is I use to work for international Airline ...I would def conslut a lawyer.Hope you friend does not get in trouble for ading a betting a criminal.Reason I say this.She knew he was going to get deported but married him to help him out..This sounds like real big mess...Good Luck..! :confused:
