Still F2b

Hi I am a Pakistani and I am a petitioner of F2B. And I am still waiting for my case approval. My case was filled on 22nd April 2002. and timeframe was 990 days. which has passed on 7th of January 2005. but still did not get anything from INS yet. According to backlog system they will finalize all cases which passed 36 months. So if it that so then it should be opening on 22nd april of this year. Well I am still hoping for good and I'll be upgraded my status from F2B to F1 in next year. Lets see what happend. If you get any information feel free to share with me as we can share our feeling over here and looking for good.

am f2b too

Hi Mus24, unfortunately I'm not from any of the country that you have metnion in your post but maybe my information will be helpful :) . So, in December 2004 my father became USC and we sent copy of his naturalization certificate and cover letter to VSC to upgrade my petition from F2B to F1. VSC received it on 19th January 2005 and on 8th February my petition has been approved :D and they sent it to NVC. Now we are waiting for the reply from NVC since my prority date is current. I hope they contact me very soon :) . I wish you all, all the best :) .

still F2B

evi thanks so very much for your reply, i actuall forgot to mention in my last post that am A NIGERIAN, well i hope my father naturalizes soon bcos hes over due,he has been a LPR for 13years, anyway evi you dint mention your dates, its about sharing those dates ,so that we can have an idea of the time frame for the F2B category, and possibly if one moves to F1 OR F3 as the case may be, evi once more thanks for your reply.

Hi :) , I'm not sure if you ask about these dates but here they are:
08/20/2000 - VSC recived my application (my father applied on behalf of me when he was LPR)
08/20/2000 - my priority date
12/15/2004 - my father became USC,
01/06/2005 - we sent copy of father's naturalization certificate and cover letter to VSC to upgrade my status from F2B to F1,
01/19/2005 - VSC received documents and made update,
02/08/2005 - my petiton has been approved
02/18/2005 - we received letter from VSC informing us that case has been approved and all documents were fowarded to NVC.
Now I am waiting for the reply from the NVC.
I hope that these are the dates that you asked for :) . if you have any farther question, just ask.

Congratulation Evi

Congratulation Evi that atleast you got NOA from INS. I hope you will be ok and will find your interview and immigrtion visa near in future. As you mention your I-130 petition date is 8/20/2000. It is also current date right now in VSC for F2b. But F1 is much better than F2b. I hope and Pray that you will get your immigration visa soon. OK let me know pls. which country you belong and when your father had moved to US? Hi sulebraimah why your father took so long to be LPR. I mean why he has not gotten citizenship yet. See you soon Guys. Once again Evi kindly share your all updates when you got somethig. Pls. :) :D

Hi aliazmat76 :)
1) I am from Poland :) ,
2) My father moved to the USA quite long time ago :D , but he received his GC just 6 years ago and he applied for a GC for me right away.

I still didn't get anything from NVC, but I think it is too soon to hear from them. I will let you know if I receive something. Best regards Evi :)

Fyi

just FYI, my mom (USC) applied for my GC in February 2002 and I'm still waiting for 130 approval from INS =(

Thanks

Thanks Evi for your updates. Yes pls. update me whenever you will get something. & Mocka1999 which service center your mom has filled petition for you. ? You asked 36 months backlog. If you can download backlog file from uscic.gov site then you will have clear idea what is that mean. But I let you know something which in my information and e.g all cases which will complete 36 months in 2005 will be open and they will either approve or reject. So kindly downlod backlog system file and read it carefully and let me know if you get something in it

She filed her petition in California Processing Center -- we got the receipt on Feb 07, 2002, i.e. more than 36 months ago. Can you guys publish a direct URL of the document that dealing with the 36 months issue (aliazmat76, the url you provided is invalid). I'm asking becuase I'm not very clear -- Visa Bulletin states that the current priority date for 'Family 1' is 22FEB01, i.e. ~ 4 years. Does this mean that 36 month old cases will be processed earlier than that?...

Hi Mockba1999, I'm not sure but I think that right now USCIS approves only those petitions which priority date is approaching, so you may wait a little longer to have your petition approved, I hope I'm wrong and your petition will be approved soon. Regards Evi

update

Hi guys :) as I promised I update you on my case. Yesterday (03/07/2005) my father received first documents from NVC, namely I-864 form (Affidavit of Support) processing fee bill and DS-3023 form (Choice of Address and Agent) so I think that the whole process has just started. We are going to send it back to NVC this week and we will be waiting for Affidavit of Support form. If you have any questions, just ask :) .

Congratulation

Hi Evi. Congratulation. that your father got I-864 form. It's mean your case has started moving to your green card. That very good news. Good Luck and take care.

I-130 approved

I also want to update you guys -- my mom just got notified via email that her 'family one' I-130 case (U.S. citizen filing for an unmarried son or daughter over 21) was approved. Despite the fact that Cal Processing Center states that it is currently processing cases with the receipt date of September 01, 2001 (we got our receipt on Feb 07, 2002) :

https://egov.immigration.gov/cris/jsps/Processtimes.jsp?SeviceCenter=California

But as I understand, I still cannot apply for adjustment of status until my priority date is current, i.e. earlier than the cut-off date listed below

http://travel.state.gov/visa/frvi/bulletin/bulletin_2111.html

am I right?...

Hi Mockba1999, I would like to say that I'm happy that your petition is also approved :) . As to your question I think that you're right. To be able to file for AOS your petition must be approved and visa number must be available to you, which means that your priority date must be current. By checking visa bulletin you can predict when your prority date will be current and you can also, thanks to that, prepare essencial documents in advance, and file them as soon as your priority date become current.
