Long term job assignment

Hi,

I would like your opinion about the situation I am currently facing.

- My manager wants to send me to a subsidiary for a new project for at least a year or possibly more.
- I am probably close to I-485 approval as corporate immigration attoney replied to RFE (employment verification) last week.
- I have AP document which is valid until Oct 2004.

And here is my thought which I am not sure if it works.

1. Without waiting for I485 approval, I go overseas carrying with AP document
2. I return to the US by Oct 2004 to renew AP document or to get my passport stamped
3. If my passport get stamped, then I apply for reentry permit
4. I fly overseas without waiting for reentry permit approval
5. If reentry permit approved within 6 mo, that is fine
If not approved yet, I return to the US and stay for a while and again I fly to subsidiary.

Any opinions would be welcomed.

AFAIK, you can travel on AP and re-enter on AP. It does not matter if your 485 gets approved when you are gone.

You should never travel on a H or L visa with your 485 close to approval -- if the approval comes thru and you enter on H/L visa there will be problems - but since you have AP it does not apply to your case.

Is it at all possible to delay this whole thing till your approval and stamping gets done ?

Usually RFEs mean you are within a few weeks of approval.

Am not sure about the reentry permits and such..

That is good to know I can travel with AP and it's okay to get my I485 approved while I am on overseas.

I currently have no idea about the timeline when I will have to leave U.S. But it is most likely to happen next 1~2 mo or so. I will have to be prepared for some scenarios depending on the approval date.
