long RFE (EB1A), please give some suggestion

extraordinary ability is defined as "a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor". This level of expertise is normally recognized in winners of international prizes and awards or those that can establish that they are nationally or internationally famour in their field of endeavor. You must submit additional evidence that demonstrates that the alien has sustained national or international acclaim and that this achievements have been recognized as extraordinary by others in field. Such evidence shall include evidence of a one-time achievement (that is, a major international recognized award), or at least three of the following:

(1) Documentation of the alien's receipt of lesser nationally or internationally recognized prizes or award for excellence in the field of endeaver (academic awards such as scholarships usually reflect only upon the beneficiary's abilities as a student)

(2) Documentation of the alien's membership in associations in the field for which classification is sought, which required outstanding achievements of their members, as judged by recognized national or international experts (Most professional associations do not require outstanding achievements of their members)

(3) Published material about the alien in professional or major trade publications or other major media relating to your field for which classification is sought. (Mere reference to the alien's work or inclusion of the alien's publications in bibliographies or footness is insufficient.)

(4) Evidence of the alien's participation on a panel, or indevidually, as a judge of the work of others in the same or an allied field of specializaiton (work as a reviewer for journals is generally not considered to have satisfied this requirement if such work is performed on an ad hoc bais, as is the case here)

(5) Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field (They cannot be considered of major significance if there is only a perceived or anticipated benefit)

(6) Evidence of alien's authorship of scholarly articals in the field, in professional or major trade publicationns or other major media (there shold be a substained history of first-authored publications in major publications.)

Note, the mere submission of three or more of the above items may not establish elegibility for this classification. The evidence must clearly demonstrate that the alien has sustained national or international acclaim and that the alien's achievements have been recognized as extraordinary by other in the field


Please help! All credentials are qestioned in the letter. I'm frustrated to see this result.

My credentials (11 journals in Biology, most in international journal, 5 in first author, 50 citations, 2 memberships, 1 review for an internationa journal, one international scholarship when I was a PhD student)

RD (Jan 21), transferred from CSC to TSC on March.
 
This RFE sounds like the description of what is required for EA! How did you prepar your cover letter? Did you CLEARLY list/explain that you fit the categories listed below using the same text , for example, "1.Evidence that Dr. Cottontail has membership in associations...) and so on?

I got an RFE for NIW also because I didn't clearly put in my letter the 3 main prongs for NIW. All the evidences were already there in my original application (I had references already commenting on why labor certification should be waived in my case, for example!) but I failed to show that in my first letter, but I did it in my RFE letter.

Hope other people here whom has done EA application and got it can help you more here.

If you were to read AAO decisions on the USCIS site, you will note that you must demonstrate by extensive documnetation that you satisfy the "extraordinary" requirement for at least 3 criterias, and had sustained national/international acclaim.
Your qualifications seem fine. Perhaps you cover letter could have been strengthen further. Since you got an RFE, you need to get more reference letters to show that you are among the top 1-2% in your field in each of the three criterias that you claim. Merely meeting the criteria do not qualify for this classification. So the key point here is that you have to demonstrate that you have attained the national/international acclaim (among the top 2%) at the time you submit your petition.

Thank you. But I don't have any evidence to be top 1-2%. I am dead for sure.

I did.

cottontail remember that you dont have to be top 1-2%, but it must appear that you are within top 1-2 or at least 5%.

Thank you. But I have to provide evidence. What evidence do you think I need to collect?
 
The officer clearlt mentioned what looking for . Under each criteria, its there in brackets. So you know what u need to submit.
 
I think you could get some additional strong references and asked them to make that kind of comment "according to my expert opinion, dr. cotton is among the top 1% because ..." and so on.

Thank you so much. Anyone knows what membership requires outstanding achievements?
 
A member of National Academy of Sciences, a Fellow of technical societies, etc. qualify under this criteria. In most cases, if the selection process for membership is a difficult one, you can definately count those in and clearly state the admission process. If you could easily apply for membership just by having a bachelor's degree and pay the annual dues, such memberships generally do not carry a significant or any weight. But you can always mention them in your petition.
 
I think for EB1EA, an award is usually needed; if it is not avaialbe, the reference letters would be of much more importance.

You would need the big names in your field clearly states in their letters to certify that you have the national/international reputation, sentence like " among the small group of people worldwide with the technique of ...." , " be recognized as the leading expert in .... " , " playing a critical/leading role in national lab "etc.

As for the membership, i don't think it is that important unless it is really an elite one.
