Now that Ohata memo is bing implemented. If 140 and 485 cases have not been approved upto 30 days after the current processing date value goes past the Receipt date, can applicants start an Inquiry BASED ON THE 140 RD and Processing date , since the various directives by USCIS seem to state that the 140 receipt date is the date that will control the 485 too!
Second issue is how will cases that were applied prior to April 30 04 initiate inquiry based on the above logic. There are cases like mine applied in Sept 03 that seem to be stuck w/o any processing so far since they seem to haev been slotted for concurrent approval as per Ohata memo. HOWEVER USCIS does not seem to officially acknowledge that it is doing this. How can we force USCIS to acknowledge?
