As H-1B holder, I want to register an LLC with 1 or 2 US Citizens or permanent residents, each of them having up to 5% interests in the company. There would be no salaried employees in the company. I would finance the company, would not do any work but would take all tax advantages.

When I am eligible to change employer based on AC 21, with approved I-140 - can I start working in my own company, continuing on similar job nature as salaried employee and continue with my I-485 petition ?
