Hi all,
My EB1-OR (outstanding researcher) was approved and I filed I485 based on EB1-OR a month ago. Now I know my EB2-NIW has also been approved. Can I link both I-140 approvals with one I485? Since EB1-OR is filed by my employer, but NIW is self-petitioned, is it safer to use NIW for I485 since my unit will be spun off soon? If I cannot use NIW I-140 now, after how long will it expire?

Thanks!

You can write to BCIS and ask them to link your I-485 with your approved NIW I-140. However, you can't expect any response from them.

thanks. i called my attorney, and he also suggested writing a letter to inform BCIS, but not specifying link which I-140 to I-485. I guess that means we can link two I-140s to I-485 then?

file 2 I485 at different service centers?

my I-485 linked with approved I-140 of EB1-Outstanding Researcher was filed at California Service Center. Can I file a new I-485 linked with approved NIW I-140 at Texas Service Center?

Yes, you can link two I-140s to one I-485, but in your case, I guess you want your I-485 to be linked with your NIW, right?

Regarding the second question, you may not choose the center to file your petition. It depends on where you are working and living.

Tigermouse,

I dont know about the I-140 linking, but this much I can say. If your choice is to file I-485 at CSC or TSC (based on where your I-140 has been filed), then choose CSC. Texas is processing I-485 at 1-2-2001; CSC at 12-16-2001

thanks for you reply. Although i'm living and working in Texas, my employer (having offices in both TX and CA) has some agreement with CSC, all I-140 and I485 cases filed by my employer are filed at CSC. Thus my I485 based on EB1-OR is filed at CSC. I wonder if I ask CSC to link it with my self-petitioned NIW I-140, will my I485 be transferred back to TSC? I don't want it happen as TSC is slower in processing I485.
