I am currently employed in and on an H1B visa.
I am strongly considering an offer with another firm who is offering to help me first with the H1B "transfer" (I understand that it is technically a new H1B application?) and then apply for green card. However the nature of this position is that I can work from my home in the US.
What is everyone's thoughts that my H1B "transfer" and green card will be approved given that technically I could do this job back in Canada where I'm from? Are there ways that the position could be worded or other angles we can emphasize to help with a successful application? Is is worth risking giving up my current H1B visa for a chance that the new H1B won't be approved because it's a home-office position? I suppose that I can't really work for the new company until a new H1B visa is issued though.
