In order to apply for 7th yr extension, we need letter from labor.

1. Does the letter from SESA/SWA say "Labor is pending from Mon-DD-YYYY" or will it say " Labor is pending for more than 365 days" ? What I mean is, will the letter say number of days pending or just from when its pending??

2. Is this letter necessary? when filed for labor a year ago, dont we get a receipt saying " Your labor priority date is Mon-DD-YYYY". Can we use that receipt itself to show that the labor is pending for a year?

anyone who filed for 7th year extensions may know this, please answer!

u get a receipt from the DOL when you submitted your labor case . That will prove that it is pending for more than 1 year

The two best documents that can be used as evidence of 1yr pending LC are your LC receipt notice and a letter from SESA/SWA that verifies your pending case age.

If you receive LC receipt that would be the best bet. But some states, in some cases they may not receive any receipt. In suce cases your company or your lawyer should be able to request that letter. SESA/SWA agreed to provide such letters.

But don't take any chances by using any other document as evidence.
