This s**ty oct bulletin is absolutely ridiculous in so many levels that one can't even begin to enumerate them. While CIS kept approving 2004-2005 cases, apparently they had backlogs from 98/99.

I propose that we join forces against this injustice and say "no" to this bonded labor. We can't be expected to shun our career prospects for 5 yrs to come. We should hire lawyer such as Rajiv or likes of ACLU to represent us.


Rajeev plz help and guide us in fighting this injustice.

Injustice was when PD was current, applicants under VSC getting 485 approved within months while NSC sending trivial RFEs after putting the application on hold for several years. Now that PD has been established, order has been restored; applications will be approved strictly by order or LC filing.
Regarding retrogression of PD back to 6-7 seven years, this is a direct
consequence of AC-21 law which allowed H1s to be extended beyond 6 years
while number of EB visas has remained the same. Back in 90s most immigrant workers applied GC within 2-3 years up on landing in US or had to go back after 6th year.

Bottomline, too little visa numbers allocated by law but too many applicants.
I doubt upcoming Kennedy act will help the situation much. Unless the senate/congress is convinced that there is acute shortage of tech workes (like nurses) don't expect much improvement.

Applicants from 2004, 2005 were getting approved while applicants from 1999 - 2000 were waiting in line for who knows what reason...

This would atleast bring some process to the chaos...and available visa no.s would be allocated to people who are waiting in the queue atleast...

I am a 2001 applicant...90 - 95% of my 2001 fellow applicants have been
approved....Few of us are waiting for name check or whatever the reason be...

I wouldn't mind waiting for 98 - 99 applicant's [if any remaining] to get approved....but it doesn't seem right to me if a 2005 applicant with PERM get's approved before me...
