Legal Stay Question (for H1B's) ? Jaxen/JMill/Experts Pl. help needed

My H1B got expired on 11/17/02 (Including I-94 and Passport visa stamping). My current employer filed for extension and received EAC# with Receipt Date : 11/15/02(Before Expiring H1B) and Notice Date : 11/20/02(After Expiring H1B)

My question is :

1. Am I in legal stay for that 3 day (18th - 20th)?
2. What is the date INS considers?
a) Date they receive our documents through UPS/FedEx.
b). Receipt Date
or c) Notice Date.

RD is the important date. There's no way to control how long it takes them to process the notice so that delay cannot be held against you.
