Legal status during conversion of B2 to green card

Hello,

I have a question regarding conversion of B2 status to permanent residency for my father-in-law. My husband is a US citizen and he is planning to apply for GC for my father-in-law. My father-in-law came to US 3 months ago on B2 visitor's visa and he has 3 more months before his I-94 expires. We want to know if he will be in legal status to continue to stay in US if the GC application is sent now because the GC application can take more than 6 months for processing and he has only 3 months left on his visitor's visa.

As long as application is pending and you get recipt he is fine. If approved you are done, if denied you can appeal. Do it through lawyer.
