Legal Resident Status

My H1 B expired 11/19/2003. I had 2 more years to go, but the company decided against extending the visa as I have a valid EAD.

I bought a house and refi-ed it once in Dec 2001. I am trying to refy it again and the lenders are making a big cry about my legal resident status (not permanent resident). They dont think I am legal here as my visa is expired.

Does anyone know a link to gov website that states that a person applied for I 485 or valid EAD card is in legal standing until a decision is made on their application?

Any other suggestions?

I had the same issue, it does not matter what you show them, you dont have a card or paper that shows that you a permanent resident. It has to be black or white for them.

I extended by h-b for the 7th year, and they accepted that.

I am going through some internet banks. They would have been willing if atleast my H1 was valid. It just expired in Nov 19, 2003. I dont think my company (big one) would extend it now.

Its frustrating - a couple companies (which had good rates) already denied processing. I am wasting my time to get a good rate!!

Can you give me the company names who processed the loan for you?

I guess if I didnt tell them that I was not a PR, there wouldnt have been a problem. But they ask whether you are a PR or not, and I didnt want to lie.
 
Caution

If there is anyone out there who is contemplating whether to renew their H1 visas after getting EAD... Please renew (or extend) your H1 B for this cause atleast..

All lenders I talked to say that since the recent patriot act, they want proof of visa or greencard if you are not a US citizen.
 
You might want to talk to this brokerage company if you are located in IL. It is called AAA Federal Mortgage CO, Chicago, IL. I think that they have worked with people with work, EAD and V visa situation.
