Left Job, but before joining new company had to leave contry in Emergency

Hi All,

I left my last employer and next day I had to join a new employer on EAD/AP. But that night I have to leave country because of medical emergency. I want to know am I still elidgible to come back to US on my AP/EAD. Here are some of the things in my situation:

1. I never used AP/EAD till now and had valid H1B from last 10 Years(Kept getting extension)
2. I am outside US from 3 weeks and hope to stay here for more than 2 weeks.
3. My AP is available till March 2011 and EAD till 2012 April

Please let me know what I need to do if I can come to US.

You can use AP to enter country (use AP and not H1 as you have changed employers). There is not restriction that you should be employed by the GC sponsor. Just make sure you have current job letter to show if asked for at POE.

But the offer letter I have is 5 weeks old. New Company is willing to hire me once I reach US
