Immigration reject my AOS, and I have to rush back to my home country. MY I-94 was taken back my immigration office during the interview. Can I leave US without the I-94

Please advise

i am no expert but as far as i know leaving is always a bad idea...

before the interview, had you overstayed your visa and if yes u need to be careful...i think something less than 180 days overstay will result in 3 years ban (i am not sure though) if you overstayed more than 180 days i think it is 10 years.

you might want to call uscis to make sure...

Leaving won't be a problem. Although they take the I94 they generally don't notice if you don't have one.

However, if you have had your AOS rejected then you may be out of status which could make coming back much harder.

Hi:

Of course you can leave the US without your I94. You do not mention on what grounds it was rejected and whether you would like to appeal the decision. However, if you merely wish to return, just do so.
