Leaving the country ..... PLEASE HELP

I have applied for my Green Card through EB3 (Consular Processing). Currently work in the US for the sponsoring company on H1B. I also have Canadian permanent residency.

I am planning on going overseas to India for a visit.

Can I leave to India and back from Canada and return to US through the land boarder using my H1b (I-797 form)?

Though I have a valid H1b my passport visa issued by the US consulate has expired.

My understanding is that since I have Canadian PR I should be able to fly from Canada and return back to Canada and back to US.

Am I correct here?

Well, currently I go back and forth from US to Canada and back with my I-797.

I can't go out directly from US to anther country and back because I don't have a visa on my passport that would enable me to travel out and back directly from US.

My question is, is it ok for me to depart from Canada and return to Canada and drive to US through a land border.

I would appreciate so much if an attorney can answer this question.

you will need a valid US visa to return to US.
 
Just get the H1B stamped. You can always be denied entry if the IO at the border suspect suspicious activity. Your travel plans certain indicate deliberate deception and an attempt to go around US immigration laws.

If you need an attorney to answer a question, you need to pay for a consultation. An attorney's time is how they earn their income.

Legally you are allowed to that only when visit is restricted to Canada only. You may get in without trouble but if u are not.. then keep the backup plan ( H1 visa stamping in Canada??).

Canadian immigration department is also very strict these days when people having PR card but no intention to live in Canada. Be prepare for those answers too.
