leaving for 2 years

Hi
I have to leave next week, family emergency, and medical needs for my son. My son, 9, who also has a Greencard is coming with me.
Since school will start soon i will register him in germany. i have another child here, 6, with the ex who has custody. that child is us citizen. so i definately want to come back. I will use that time to get back on my feet and go back to school over here to get a degree.
i will travel back several times a year to visit my other child,
here is my question.
if i apply for a reentry permit, but i am leaving next week, can i come back for the biometrics?
do i have to file a seperate reentry permit for my 9 year old including the extra fees? When we applied for our visa, he was always included in my application since he is a minor.

if i have to pay for him too, than i dont have enough money right now to do everything before we leave. what are the chances of us not loosing our visa without a reentry permit?

what are your suggestions?
 
You have to be in the US when you file the reentry permit (including when USCIS receives it), and show up for biometrics, but you can leave the US in between.

Your 9 year old will need his own separate permit. If anything he needs it more than you since you will be returning multiple times per year while he apparently will not. However, he may already be a citizen based on the Child Citizenship Act if his other parent is a US citizen and certain conditions have been met. So he can get a US passport and wouldn't need a reentry permit.

If you leave the US for a year or more without a reentry permit, the GC is voided and you have to hope the consulate will grant a Returning Resident Visa.
