Leave U.S. after filing N-400

I live in SF and get my GC through marriage to a USC and will file N-400 3 months before the 3-yr period. My spouse wants to leave the U.S. for job opportunities abroad (not U.S. firm) shortly before or after I file N-400. My questions are:

- If my spouse leaves the U.S. while I stay in the U.S. during the application process, would that create a problem?

- Can I leave the U.S. after filing N-400 and simply come back for the interview/oath ceremony?

- Can fingerprinting be done abroad? If not, how long of a wait from filing N-400 to fingerprinting?

Hi JoeF,

Thanks for the reply. For the first question, given that the 3-yr rule applies only to GC holder who is still married to and live with the USC spouse, wouldn't that imply if my USC spouse leaves the U.S. for an overseas job (potentially permanently) while I apply for citizenship indicate that the two of us are not "living together"?

No.
You have to continue to reside in the US, more specificially in the district that the CIS office where you apply serves. That doesn't prevent trips abroad, of course.
And you are still a PR, so, you have to reside in the US, anyway.
No.
That varies. That's actually one reason why it is not recommended to go on long trips abroad.

Hi joef

suppose after applying N400, in one state , some body get a job in another state, what he will do??? he has to stay in the state where he applied or, he can move and change the address with INS , or move and keep his application with the old SC??

another question, when somebody move to other state what is the proof that he is resident in that state, is it the lease and bills?? suppose there is no lease and bills?

when is the official start of his residency, is it when he get his new ID card?
or is it when he moved? some body can move to another state and dont apply for ID only after couple of months is that mean that he was not residing in that state for those months?

thankx
