LCA renewal ... what date from end of prior LCA?

please help.

previous LCA and H1 is from May 20, 2001 to May 20, 2004.
(processed by attorney)

for renewal LCA/H1 (to be self processed), what date do i write:

May 21, 2004 - May 21, 2007
or
May 20, 2004 - may 20, 2007
or
May 21, 2004 - may 20, 2007
or
may 20, 2004 - may 19, 2007

confused? so am i!

You can put even from Jan. 04 to Jan 07 this is does not matter.
I am going to do same thing.Any up date share with me.I am going to extend H-B1 myself too.

correct LCA/H1 dates for renewal ....

the original LCA/H1 approval was: May 20, 2001 to May 20, 2004
(i.e. 3 years and 1 day).

USCIS policy states that H1 can be approved for 3 years at a time (not 3 years and 1 day), so original approval should have been from May 20, 2001 to May 19, 2004. Looks like a mistake by USCIS. I believe, you are not allowed to take advantage of USCIS mistake even if it helps you.

so if original LCA/H1 approval was (supposed to be) May 20, 2001 to May 19, 2004, then 3 yr renewal will be from May 20, 2004 to May 19, 2007.
hence, the new LCA/H1 should be filed for May 20, 2004 to May 19, 2007 even if the original approval was from May 20, 2001 to may 20, 2004.

Hi,
See on form ETA 9035 right hand side all the way up , you will see there Exp. Date. So this should be considered.

In Section C Period of Employment and Occupation Information,
can be any date.That date does not metter.

ETA9035 exp date is nov 30, 2003

ETA9035 form available from dol website at this link: http://workforcesecurity.doleta.gov/foreign/preh1bform.asp

shows an exp date of Nov 30, 2003. it's Jan 24, 2004 today

obviously, DOL people are also human and make mistakes too.

i believe it's just an oversight and this form should be good at this time.

Can I send copy of old one.I spoke to the company who did it last time for me,they said there is no exp. date for that.

What is Prior Petition Number?

My Employer gave me raise so do I just chance Rate of Pay in I-129 and LCA.I got approval already from Division of Research & Statistic.

Can I fil up all forms by hand writing.

Here is all the list of forms I have.Tell me if i need anything else.

Form I-129,
I-129H
I-129W
ETA 9035 (How I do Electronic Filing)
I- 907 and

Letter on company's stationary.All copys of degree and diploma and orignal I-797 with I-94.

your pay has to be within 95% of the prevailing wage for the job being sponsored. can be more, not less

why in the world do you want to do that? all forms are fillable
