LC under PERM question

Unbelievably, I found someone who will sponsor me for an EB2, and I don’t even work for them yet. I think they think they may as well start the process now (and H1B in April) rather than just hang around and wait for October 2007. Now, I have spent so long learning about LC, form ETA 9089 (or something like that) and I140 and I485. But nowhere can I find how long this takes (or maybe I have not looked hard enough). Some seem to take months, some years, some seem to go in very quickly. Any any help anyone can offer would be fantastic. I am an audit manager, will be working in Florida (not sure if that makes a difference), have a Bsc + 5 years experience + professional accountancy qualification. The priority date is currently current for me.

Thank you!

A good PERM case usually takes about 90 days to be completely put together. Depending on which service center you apply to (hopefully you'll get Chicago), the case can be approved in 2 days to over a year. The majority of the Chicago cases we have filed are approved in 2 weeks or less. If your EB2 PERM case gets approved, let's say, in 3 months, then you can file your I-140 and I-485 concurrently (because you are one of the lucky ones from "other" countries with an EB2 case -- see visa bulletin here: http://travel.state.gov/visa/frvi/bulletin/bulletin_3046.html). Assuming that your company is bonafide, and your I-140 goes through without any major issues, that should be approved in 6 months or less (you can also file it premium processing for an extra $1000 fee, and a decision will be issued in 15 days). The I-485 will depend which service center you file at. I believe most of the service centers are working on cases filed in April 2006. So hopefully, yours would be approved in about a year or less. This is just an estimation, but at least you can get some idea of the time-line.

Thank you!

I better tell them to put their skates on then!

It seems the longest thing is to put the LC "application" together + all the adverts

Not a problem :)
The hardest part, I've found, is to get the company to cooperate. The ads have to be a certain way, the recruitment has to be a certain way, etc. etc. The application itself is not THAT bad once you know your way around it. Some of the questions I can answer in my sleep these days. The supporting documentation is the most difficult part!

st4rguitar/to all - question, where are I140s and I485s filed these days? I have seen a USCIS memo indicating that the said forms are to be filed with nebraska and texas? Also, whats the current processing times - it seems that the information on USCIS's website may not have been updated as they are showing circa 2005 for adjudicating I485s at VSC.

Also, what's your opinion about consular processing versus AOS?

Mkung,
I'm shocked you would even ask me a question, judging by the way you've rudely replied to my posts and doubted/contradicted my experience/information.

You take things too personally :). I do enjoy your posts and find them informative. However, there are some inaccuracies (we are all human after all) and I need to say something when and if I come across such inaccuracies.

So, can you please respond to my query?

As every service center was significantly backlogged due to the priority dates moving forward, and the H-1B cap rush several months ago, the USCIS amended the way that they are handling cases.
Now, all I-140's are filed at the USCIS Lincoln(Nebraska) Service Center reference link: http://www.uscis.gov/portal/site/us...nnel=db029c7755cb9010VgnVCM10000045f3d6a1RCRD
or the PDF at http://www.uscis.gov/files/form/i-140.pdf

It's odd though. It's almost like once the I-140's GO to the USCIS, that they outsource them to the other service centers! I.E., we received an I-140 RFE from California, yet the case was filed in Lincoln. Interesting, eh?

Some clients choose consular processing. We never really recommend it b/c there is the issue of not being able to track it easily like you can with a 485 receipt number. Also, many of the consulates are backlogged NOT including the visa retrogression. So, we always opt for I-485 processing instead of consular pro.
