LC substitution

Hi Gurus,

My company has an approved LC. This LC has been used to file I-140 and the I-140 was approved in 2000. But The beneficiary left the country for good and he never file I-485. One lawyer told me I can substitute the LC after he did some research on the web. Another lawyer told me he does not know. Does any of you know the truth. What's the reuirements for the substitution except the matching of the experience and education.

Finally I found one on the same boat.

No any further information. One atterney is very positive about it, but another is not sure. She recommended me to call Fragoman law office for advice. I haven't got the response.

Have you got any positive information about the substitution?

Further questions for you.

1. What did your attorney tell you about the substitution when you decided to apply? very positive?

2. You only have the copy of the old LC. Did you send a copy of the LC or a certified copy of the old LC with your I-140?

3. How long have you been applied? Do you know the failure rate of the this kind of substitution?

1)My attorney is very positive about this case. I was not even aware that 140 being approved would cause i problem.

2)Not aware about the LC substition papers, as my lawyer handled both the cases.

3)I have applied in August.

Substitution

You can substitute the beneficiary for LC only if the new person has the same background and experience and education as the old beneficiary.

For instance: you company has an unused LC for Oracle DBA with 4 years experience and Oracle certification.

You can use this LC only if you are Oracle DBA with 4 years experience and Oracle certification.
