LC substitution educational qualifications question

Hi everyone,

My company has a preapproved LC requiring Bachelor's degree in Business or Finance. Can this be used as a substitute for someone with a Bachelor's degree in Engineering instead? The work experience requirements and job title are same.

Please let me knoe your comments.

No,It will be a problem later.

From what I've researched so far, you need to have an educational evaluation done from a reputed firm/academic person who can evaluate your transcripts and make a case that you have completed sufficient credits that satisfy the minimum required education in the original LC.

I am in a similar situation. I am currently trying to get a 'labor substitution' for a pre-approved LC. The LC requirements states - 4 year College Bachelor Degree and the Major Field of Study: Computer Related

Does anyone have information on the following:
Do you think my BS in Electronics & Telecommunications
would be sufficient for this Labor? Do you know of I-140 approvals/denials in
such cases?
I had completed 27 credits of my MS in CS in a US university at the time when the original LC was filed. Can these be added to my
educational evaluation to show equivalency to a 'computer related' BS?

Hi All

I am new to this form. I am also victim of H1B 6 years limit. I want to go for labor substitution. will you please clarify me following doubts:


1.LC which I am going to use require only Bachelors and 2 years of experience. I have Bachelors (3 years from india) and masters (2 years from india) in computerscience and have 3 years experience. will it be any problem using this LC?

2. In LC under experience, previous IT guy mentioned 10 years of experience. where as I have only three years of experience. In LC under job offer require (14 th column) only 2 years of experience.will it cause any problems in my I140/I485 stages?

3.which is my priority date? is Lc (sustituted) filed date or I140 filed?

4. Can it be possible to change employers after 180 days passed and I 140 approved (luckily) in labor substitution cases?
